TREATY PROVISIONS AND BASIC DOCUMENTS WITH REGARD TO THE EU MEMBERSHIP OF
CYPRUS
1. London and Zürich Agreements (1959),
Basic Structure of the Republic of
Cyprus.-
Article 8 :
"The President and the vice-president, separately and conjointly, shall have
the right of final veto on any law or decision concerning foreign affairs,
except the participation of the Republic of Cyprus in international
organizations and pacts of alliance in which Greece and Turkey both
participate or concerning defense and security as defined in Annex I."
2. London and Zurich Agreements (1959)
Basic structure of the Republic of Cyprus - Paragraph 23 :
"The Republic of Cyprus shall accord most-favored-nation treatment to Great
Britain, Greece and Turkey for all agreements whatever their nature."
3. Treaty of Guarantee (1960)
Article 1 :
"It (The Republic of Cyprus) undertakes not to participate, in whole or in
part, in any political or economic union with any state whatsoever."
Article 2:
"They (Greece, The United Kingdom and Turkey) likewise undertake to
prohibit, so far as concerns them, any activity aimed at promoting directly
or indirectly, either union of Cyprus with any other state or partition of
the island."
4. Constitution of the Republic of Cyprus (1960) - Article 50.1 (A):
"The president and the vice-president, separately and conjointly, shall have
the right of final veto on any law or decision concerning foreign affairs.
Except the participation of the Republic of Cyprus in international
organizations and pacts of alliance in which Greece and Turkey both
participate, or concerning defense and security..."
5. Minutes of the meeting held on 12 February 1959 between the Zorlu and
Averoff, the then Foreign Ministers of Turkey and Greece :
"The intention was to exclude more favorable bilateral agreements between
Cyprus and countries other than the three powers and also to avoid the
possibility of either Greece or Turkey securing a more favorable economic
position in Cyprus than the other - of Greece, for example, establishing a
kind of economic Enosis."
6. Ten-point Agreement of 19 May 1979, between Denktas and Kyprianu
Point 8 :
"The independence, sovereignty, territorial integrity and non-alignment of
the Republic should be adequately guaranteed against union in whole or in
part with any other country and against any form of partition or
secession."
7. UN Security Council Resolutions 649, 716, 750, 774, 939 :
"... a settlement must exclude union in whole or in part with any other
country or any form of partition or secession."
